Terms and Conditions

Please read through these carefully along with our Postal Policy and Privacy Policy before placing your order and then print a copy for future reference. We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received.
 
1.   General terms and conditions
This site is owned and operated by Holly Products ("Holly Products", "we" or "us"). V.A.T No: We are not currently V.A.T Registered.
"You" and "your" etc. refer to the customer.
 
2.   Accuracy of content
We have taken every care in the preparation of the content of this website. We strive to ensure that the information and prices displayed are correct at time of publishing.
If we discover any errors in the price of goods before we accept your order, we will notify you as soon as possible and give you the option to complete your order at the correct price or cancel the order.
Prices displayed on this site may differ from those at exhibitions. All prices are displayed do not include V.A.T; we are not currently V.A.T registered.
Packaging and some designs may vary from that shown. The dimensions given are approximate only. Holly Products shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.
 
3.    Ordering
3.1  Availability
All items are subject to availability. In the event of an order being made for an unexpectedly out of stock item, Holly Products may at their discretion and without notice, remove the item from the order or send the remainder of the order when stock becomes available. Removal of items from an order will not affect the postage and packaging charge. Where we are sending the items once they are in stock we will do so at no extra postage.
 
3.2  Ordering errors
You are able to correct errors on your order up to the point at which you submit the form on the final page of our ordering process. We deal with orders as promptly as possible and cannot guarantee that we will be able to make any alterations to your order after it has been submitted.
 
3.3  Fulfilment of orders
Any shortages, discrepancies or damages with any order must be reported to us within 3 days of receipt of goods. After arrangement has been made, erroneous goods must be returned within14 days as section 5.3
 
3.4  Acknowledgment of your order
All orders are subject to scrutiny over the accuracy of address details and cardholder details. Where any of the details provided arouse suspicion in ourselves, or on the advice of our merchant service providers, we may reject any order without notice.
If you have supplied us with your email address, a confirmation email will be sent to the address supplied to confirm receipt of your order. Another email will be sent once the order has been dispatched.Any email or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance of your order.
 
4.    Delivery
4.1  Charges
Charges for delivery are not included in the stated product price. Delivery dates stated are estimates only. We cannot be held responsible for delays that are outside of our control. Delivery charges vary depending on the type of products ordered, the service and the destination and cannot be refunded.
For full details please refer to our Postal Policy. Customs charges are not included in the stated product price or the postal charge. Holly Products is not responsible for paying any customs duties.
 
 
4.2  Delays
Occasionally, the acquisition of your goods may be delayed. This can be for various reasons such as material shortages, import delays or higher-than-anticipated demand. We will, of course, make every effort to keep you informed of any delay when it is known to us.
 
5.    Alterations, Cancellations, Returns and Refunds
5.1  Alterations
Once an order has been processed (i.e. Paid for, and/or packaged, and/or ready for dispatch, or dispatched), we will not accept any requests to add products or make alterations to the contents of the order. Where possible, if an order has not been processed, additions or alterations may be made at Holly Products discretion.
 
5.2  Cancellations
Once an order has been processed (i.e. Paid for, and/or packaged, and/or ready for dispatch, or dispatched), cancellation of an order or item may incur a handling fee of 5% of the cost of that order or item. No refunds for postage and packaging will be made as we consider this to be a custom build item subject to the Distance Selling Regulations (2000).
Under current Distance Selling Regulations you have the legal right to cancel your order within seven working days of receipt of the goods. Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered. For details of how to exercise please see 5.3 Returns.
 
5.3 Returns
It is the responsibility of the customer to ensure that returned items reach Holly Products in an unused condition and original packaging. Refunds for returns that do not meet this standard may be made at Holly Products own discretion.
No goods may be returned without prior arrangement with Holly Products. Return of goods for any reason other than faults and damages must be arranged within 7 working days of receipt and successfully returned to Holly Products within 14 working days of arrangement unless arranged otherwise. Returns for any reason other than faults or damages may be subject to a handling charge of 20% of their retail price at Holly Product's discretion.
 
5.4 Refunds
Refunds will only be paid by means of original payment. Where a payment has been made by cheque, refunds will not be issued until that cheque has cleared. We will not refund onto another card issuer's credit or debit card. Refunds will only be processed upon receipt of returned goods. Postage and packaging costs for returning goods to Holly Products will be reimbursed only when goods are found to be faulty or damaged.
                               
6.   Restrictions on purchase
Where the order concerns knives, bladed articles and similar: by placing an order you confirm that you are over the age of 18.
Where the goods are for export outside of the United Kingdom, we may refuse or adjust an order where the destination country has restrictions on the goods ordered, or where the carrier is unable to accept them. In the event of goods being sent outside of the UK, it is for the customer to ensure that their goods are appropriate for use in their location and to be aware of any customs restrictions applicable at the time of ordering.
 
7.   Payments
    In addition to accepting cheques and direct bank payments, Holly Products accepts Debit and Credit Cards via a secure payment gateway through SAGEPAY.  For details of their Security Policy please see: http://www.sagepay.com/security_policy
     
8.   Account security
If at any time a password or username is required, you are responsible for maintaining the confidentiality of this information, as Holly Products does not store this information. Holly Products shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.
